The Philosophy of Law in Buddhist Scripture

Abstract

The objectives of this research are; 1) to study the principles and concepts of the Jurisprudence, 2) to study the principles and the essential importance of the Buddha's Orders (Buddhapaññatti) and 3) to analyze the jurisprudence according to the principles of the Buddha's Orders. This is a documentary research, setting out the research methodology by collecting information from the Tipitaka, textbooks, research papers and related articles in which the contents of which are analyzed and synthesized in consistence with the objectives.

The results of the research are shown as follows: 1) the rules or the traditional laws that the institution or the highest authority of the state enacted were legislated for the state administration, leading to sustain and allocate the resource and the profit for the society also, 2) the Buddha’s Orders were legislated to be the basic core principles to the religion and His disciples (to His sankha), especially monks, 3) the Buddha’s Orders were the core principles of peace and patterns as a method of conduct for the disciples. When the offences occurred, the monks would be called to meeting for investigation of the truth and then set rules for the group peacefulness. In the case of this conduct, the atmosphere would be benefited to gentle monks who strived forwards on a higher level of meditation.
